Divorce proceedings are an emotional and stressful time for all parties involved.

Courts often look towards the best interests of the child when making orders for parenting arrangements.

It is normal for both parties to be harbouring negative emotions towards each other, meaning it may be easy to forget to act in the best interests of your child. However, it is important to facilitate for your child to maintain a healthy relationship with their father. If you believe your child will be unsafe with your ex-spouse, your concerns should be raised with your legal advisor immediately.

The first thing that should be done after the establishment of a divorce is to look after your children and your finances, particularly if you are not the sole breadwinner. In most Court proceedings, parties are required to pay for their own legal costs.

You should also be documenting unusual activity in your joint bank account, as well as getting your financial paperwork in order. If possible, close the joint account and open up an independent one. This ensures your money is not being used by your ex-spouse.

Both men and women can suffer from domestic violence abuse. It may be the reason behind your separation, in which case it will be very important to document each of the events with a counsellor or legal advisor. You should approach the Police with an AVO request if necessary.
